1.4 In these Terms:
- “Sunshine”, “we”, “us” and “our” mean SUNSHINE OFFICIAL LTD trading as Sunshine Accreditation.
- “Academy” means an independent training provider approved or accredited by Sunshine.
- “Student”, “learner”, “you” and “your” mean the person undertaking or considering undertaking training with an Academy.
- “Platform” means the Sunshine Accreditation website, learner portal, certificate-verification service and associated systems.
- “Course” means a course delivered by an Academy and approved for accreditation by Sunshine.
When these Terms apply
2.1 These Terms apply when you:
- create or use a student account;
- access the Platform;
- complete online learning or theory through the Platform;
- receive a certificate that is recorded or verified through Sunshine;
- use the certificate-verification service;
- communicate with Sunshine about an accredited Academy or Course; or
- purchase a service directly from Sunshine Accreditation.
2.2 By using the Platform, you agree to these Terms.
2.3 Your Academy may also have its own booking, payment, cancellation, attendance and training terms. Those terms form a separate agreement between you and the Academy.
The role of Sunshine Accreditation
3.1 Sunshine provides private course accreditation, quality-assurance services, student systems and certificate verification.
3.2 Unless Sunshine has expressly sold and delivered the Course directly to you, your Academy is your training provider.
3.3 The Academy is responsible for:
- advertising and describing its Courses accurately;
- deciding whether you meet the Course prerequisites;
- taking your booking and payment;
- providing your training;
- supplying suitable trainers, equipment, premises and models;
- carrying out practical assessments;
- deciding whether you have met the required standard;
- dealing with attendance, transfers, cancellations and refunds;
- maintaining appropriate insurance; and
- handling your initial complaint about the training.
3.4 Sunshine does not automatically become responsible for the Academy’s acts or omissions simply because the Academy or Course is accredited by Sunshine.
3.5 Academies are independent businesses. They are not employees, agents, branches, partners or representatives of Sunshine unless we have expressly confirmed otherwise in writing.
What Sunshine accreditation means
4.1 Sunshine accreditation means that the Academy and approved Course have been reviewed against Sunshine’s private accreditation and quality-assurance standards.
4.2 Sunshine accreditation does not, by itself, mean that a Course is:
- an Ofqual-regulated qualification;
- part of the Regulated Qualifications Framework;
- a licence to practise;
- a medical qualification;
- approved by a government department;
- guaranteed to be accepted by every insurer, employer, council, professional body or overseas authority; or
- suitable for every individual learner.
4.3 A Course will only be described as an Ofqual-regulated qualification where this is expressly stated and the relevant awarding organisation and qualification details are identified.
4.4 Accreditation does not replace your responsibility to check:
- whether you meet the Course prerequisites;
- whether the Course is suitable for your intended work;
- whether your insurer will provide the cover you require;
- whether any employer, council, licensing body or professional organisation will accept the training;
- whether additional qualifications, experience, medical oversight or licences are required; and
- whether you are legally permitted to carry out the relevant treatment or service.
Student eligibility and prerequisites
5.1 You must provide complete and accurate information about your identity, qualifications, experience and insurance when requested.
5.2 You must not submit another person’s qualifications, assessments, photographs, videos, treatment evidence or identity documents as your own.
5.3 Your Academy may require evidence of:
- age and identity;
- previous qualifications;
- professional experience;
- English-language ability;
- insurance;
- first-aid training;
- anatomy and physiology knowledge; or
- any other prerequisite relevant to the Course.
5.4 Meeting the minimum entry requirements does not guarantee that you will successfully complete the Course.
5.5 Where you are under 18, your Academy may require permission from a parent or legal guardian. Additional restrictions may apply to insurance, models, treatments and professional practice.
Accounts and Platform security
6.1 You must provide accurate and current information when creating your account.
6.2 Your account is personal to you. You must not:
- share your password or login details;
- allow another person to complete learning or assessments through your account;
- access another student’s account;
- create multiple accounts to avoid restrictions;
- interfere with the Platform’s security; or
- attempt to copy, extract, reverse-engineer or misuse the Platform.
6.3 You must notify Sunshine promptly if you believe that your account has been accessed without permission.
6.4 We may require identity checks before changing account details, releasing information or discussing a student record.
6.5 We may suspend an account while we investigate suspected fraud, impersonation, cheating, misuse or a security concern.
Course information and bookings
7.1 Before booking, you should check the Course information provided by the Academy, including:
- Course content;
- delivery method;
- location;
- duration;
- prerequisites;
- practical requirements;
- assessment arrangements;
- models and equipment;
- certificate arrangements;
- price;
- cancellation terms; and
- insurance suitability.
7.2 Course descriptions, prices, dates and promotional statements made by an Academy are the Academy’s responsibility unless Sunshine has made the statement directly.
7.3 Accreditation of a Course does not guarantee that a specific Course date will proceed. The Academy is responsible for notifying you of postponements, trainer changes, venue changes or cancellations.
Payments, cancellations and refunds
8.1 Where you pay an Academy, your payment contract is with that Academy. Refunds, payment plans, deposits, transfers and cancellations will normally be governed by the Academy’s terms.
8.2 Sunshine cannot normally issue a refund for money paid directly to an Academy.
8.3 Where you purchase a service directly from Sunshine as a consumer, the price and payment terms shown at checkout or on your order confirmation will apply.
8.4 For eligible online purchases made directly from Sunshine, you will normally have 14 days from the date the contract is made to tell us that you wish to cancel.
8.5 Where you ask us to begin providing a service during the 14-day cancellation period:
- you agree that we may begin the service immediately; and
- if you later cancel, we may charge a reasonable proportion for work completed before cancellation.
8.6 Where digital content or immediate Platform access is supplied, we may ask you to expressly consent to immediate supply and acknowledge that your right to cancel may be affected once supply begins.
8.7 Nothing in these Terms removes any statutory consumer rights that apply to you.
Learning and assessment requirements
9.1 You are responsible for:
- attending the required training;
- completing theory and practical work honestly;
- following health and safety requirements;
- treating trainers, models, staff and other learners respectfully;
- submitting work by the required deadlines;
- maintaining suitable professional conduct; and
- telling the Academy about any condition or circumstance that could affect safe participation.
9.2 Completion of a Course does not automatically guarantee a pass or certificate.
9.3 Your Academy must be satisfied that you have met the required learning outcomes and practical standard before confirming achievement.
9.4 The Academy or Sunshine may require additional evidence, reassessment or clarification where submitted evidence is incomplete, inconsistent or raises quality concerns.
9.5 Sunshine may review assessment and certification decisions as part of quality assurance.
Academic and professional integrity
10.1 All work submitted in your name must be your own unless collaborative work has been expressly authorised.
10.2 You must not:
- plagiarise another person’s work;
- purchase completed assessment answers;
- submit AI-generated work without checking it and complying with the Academy’s rules;
- falsify treatment records;
- alter assessor feedback;
- manipulate dates, images or videos;
- impersonate another person;
- submit false certificates; or
- pressure an Academy to issue a certificate before competence has been demonstrated.
10.3 Suspected malpractice may result in:
- an investigation;
- temporary suspension of your account;
- cancellation of an assessment;
- withdrawal or correction of a certificate;
- notification to the Academy, insurer or another appropriate organisation where lawful and necessary; or
- removal from the Platform.
10.4 You will be given a reasonable opportunity to respond to serious allegations before a final decision is made, unless immediate action is necessary to protect students, the public or the integrity of the verification system.
Certificates and verification
11.1 A certificate may only be issued after the Academy confirms that you have successfully met the Course requirements.
11.2 Certificate issue may also depend on:
- successful completion of all required theory and practical assessments;
- receipt of complete student details;
- completion of quality-assurance checks;
- resolution of any identity or evidence concerns; and
- payment of applicable certificate or administration fees.
11.3 You are responsible for checking that your name and other certificate information are correct before or immediately after issue.
11.4 Charges may apply where a replacement certificate is required because incorrect information was originally provided.
11.5 Sunshine may maintain a verification record containing information such as:
- your name;
- Course title;
- Academy name;
- certificate number;
- issue date; and
- certificate status.
11.6 A verification result confirms that a certificate record exists within the Sunshine system. It does not confirm:
- your current competence;
- your current insurance status;
- your fitness to practise;
- that you have maintained continuing professional development;
- that you are complying with current law; or
- that every insurer or employer will accept the certificate.
11.7 Sunshine may mark a certificate as suspended, corrected, replaced or withdrawn where there is evidence of:
- fraud;
- an administrative error;
- incorrect learner information;
- an invalid assessment decision;
- serious malpractice;
- unauthorised certificate production; or
- another substantial quality-assurance concern.
11.8 We will not normally withdraw a certificate solely because an Academy’s accreditation later expires, provided that the Course was validly accredited and properly completed when the certificate was issued.
Insurance and professional practice
12.1 You must obtain confirmation directly from your intended insurer before relying on a Course for insurance purposes.
12.2 Insurance decisions may depend on matters including:
- your age;
- previous qualifications;
- experience;
- Course delivery method;
- assessment method;
- location;
- treatment type;
- professional background; and
- the insurer’s current underwriting requirements.
12.3 Sunshine cannot require an insurer to offer cover and does not guarantee the price, terms or availability of insurance.
12.4 A certificate does not authorise you to work outside your competence, insurance, legal scope or professional responsibilities.
12.5 You remain responsible for maintaining your knowledge, practical competence, continuing professional development and insurance after completing the Course.
Student conduct
13.1 You must communicate with Sunshine, the Academy, trainers, models and other learners in a professional and respectful manner.
13.2 We will not tolerate:
- threatening or abusive conduct;
- harassment or discrimination;
- deliberate disruption;
- fraudulent chargebacks;
- misuse of personal information;
- publication of confidential learner or Academy information;
- attempts to damage the Platform; or
- knowingly false or malicious complaints.
13.3 Nothing in this clause prevents you from making an honest complaint, leaving a genuine review or reporting a safeguarding, legal or quality concern.
Website and Platform availability
14.1 We aim to keep the Platform available and secure, but continuous or error-free access cannot be guaranteed.
14.2 Access may be interrupted for:
- maintenance;
- security updates;
- technical faults;
- third-party service failures;
- events outside our reasonable control; or
- urgent action required to protect users or data.
14.3 We may update, replace or withdraw Platform features where reasonably necessary. We will try to minimise disruption to essential student records and certificate verification.
14.4 You are responsible for using suitable equipment, software and internet access.
Intellectual property
15.1 The Platform, Sunshine branding, course templates, manuals, graphics, text, videos, software and verification systems are protected by intellectual-property rights.
15.2 Unless expressly permitted, you must not:
- copy or distribute Platform content;
- upload materials to file-sharing websites;
- sell or sublicense training resources;
- remove copyright notices;
- reproduce Sunshine certificates;
- copy the Sunshine accreditation logo;
- use Sunshine branding to suggest that you are an approved Academy; or
- use materials for commercial training delivery.
15.3 Materials provided for your personal study may be used only for your own learning and professional reference.
Privacy and student information
16.1 Sunshine will process personal information in accordance with its Privacy Policy.
16.2 Information may be used for purposes including:
- account administration;
- identity checks;
- learning records;
- certificate production;
- certificate verification;
- quality assurance;
- complaints and investigations;
- fraud prevention;
- safeguarding; and
- legal or regulatory compliance.
16.3 Sunshine and the Academy may need to exchange relevant information to administer your Course, certificate or complaint.
16.4 You should read both Sunshine’s Privacy Policy and your Academy’s privacy notice.
Complaints and appeals
17.1 Complaints about Course delivery, trainers, dates, payments, refunds, venues or practical training should normally be raised with the Academy first.
17.2 You should follow the Academy’s complaints procedure and allow it a reasonable opportunity to respond.
17.3 You may escalate a matter to Sunshine where it concerns:
- accreditation standards;
- certificate validity;
- assessment integrity;
- serious malpractice;
- safeguarding;
- misleading use of the Sunshine logo; or
- an Academy’s failure to operate an appropriate complaints process.
17.4 Sunshine’s review will focus on accreditation and quality-assurance matters. We may not have authority to order an independent Academy to pay compensation or issue a refund.
17.5 An appeal against a Sunshine decision must be submitted in writing within the period stated in the relevant decision or Appeals Policy.
Our responsibility to you
18.1 Nothing in these Terms excludes or restricts liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- your statutory consumer rights.
18.2 Sunshine is responsible for foreseeable loss or damage directly caused by our failure to use reasonable care and skill.
18.3 Sunshine is not responsible for loss caused by:
- an Academy’s acts or omissions;
- inaccurate information supplied by you or an Academy;
- your failure to meet prerequisites;
- an insurer, employer or authority refusing to accept a Course;
- your use of a treatment or skill outside your competence or insurance;
- events outside our reasonable control; or
- misuse of your account.
18.4 Where you use the Platform wholly or mainly for business purposes, Sunshine will not be liable for loss of profit, revenue, business, contracts, goodwill or opportunity, except where the law does not allow that liability to be excluded.
Suspension and termination
19.1 We may suspend or terminate your access where:
- you seriously or repeatedly breach these Terms;
- you misuse the Platform;
- fraud or impersonation is suspected;
- suspension is required to protect another person;
- we are required to act by law; or
- the relevant Academy or Course is under a serious quality-assurance investigation.
19.2 Where reasonably possible, we will explain the reason and allow you to provide relevant information.
19.3 Termination of Platform access does not automatically remove a valid certificate record unless there are separate grounds to correct, suspend or withdraw that certificate.
Changes to these Terms
20.1 We may update these Terms to reflect:
- changes in law;
- changes to accreditation standards;
- new Platform features;
- security requirements; or
- changes to our services.
20.2 The latest version will be published on the website with an updated date.
20.3 Material changes affecting an existing paid service will be communicated where reasonably practicable.
General provisions
21.1 If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
21.2 A delay in enforcing these Terms does not mean that Sunshine has waived its rights.
21.3 No person other than you and Sunshine has a right to enforce these Terms, except where the law provides otherwise.
21.4 These Terms, together with any applicable order confirmation and policies referred to within them, form the agreement between you and Sunshine concerning your use of the Platform.
Governing law
22.1 These Terms are governed by the laws of England and Wales.
22.2 If you are a consumer living in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts where you live.
22.3 Before starting court proceedings, both parties should try to resolve the matter through the applicable complaints process.
